What Counts as Personal Data?
CCTV images that can identify a member of the public are classified as personal data under UK law. This means they must be respected, protected, and managed in full compliance with the Data Protection Act (DPA) and GDPR.
Why Does It Matter?
Failure to comply — through mis-use, mis-management, or abuse of CCTV images — can lead to prosecution, enforcement action by the ICO, or your footage being ruled inadmissible as evidence in court.
Your Legal Obligations
The UK GDPR and Data Protection Act 2018 apply to all types of CCTV systems where personal data is obtained, recorded, or stored in the form of video images. If your system captures images of identifiable individuals, you must comply with the following requirements:
Since 25 May 2018, every organisation or sole trader that processes personal information must pay a data protection fee to the ICO, unless they are exempt. You can register or check your obligations at ico.org.uk or by calling 0303 123 1113.
Domestic CCTV Users
If you use CCTV to monitor your own property — even if your cameras film beyond your property boundary — you are exempt from paying the data protection fee. However, you should still be mindful of your neighbours’ privacy and follow best practice.
